DVD Preservation ex parte summary

Abstract

On June 22, 2021, on behalf of the Library Copyright Alliance, several members had an ex parte meeting with Copyright Office staff to discuss LCA’s petition for an exemption for Class 5, the preservation of DVDs and Blu-ray discs in the collections of libraries, archives, and museums. the focus of the petition was not motion pictures produced by major studios. Rather, independent films, foreign films, or documentaries produced for public television that are not widely available, or are expensive, damaged, or at risk of being lost. These materials are in need of preservation, which libraries, museums and archives are perfectly situated to do. LCA is seeking an exemption for purposes or preservation and replacement within the meaning of 17 U.S.C. § 108.
