ALAWON: American Library Association Washington Office Newsline Volume 11, Number 54 July 1, 2002 In This Issue: FCC Provides for CIPA Remedies Including Year 4 On Friday, June 28, the Federal Communications Commission (FCC) released an order (FCC 02-196) providing additional details about its adjustments to implementation of the Children's Internet Protection Act (CIPA) in view of the recent court decision declaring CIPA unconstitutional as applied to public libraries. The order also instructs the Schools and Libraries Division of USAC to take certain actions that will further clarify the E-rate situation for libraries. The order does the following and becomes effective upon its publication in the Federal Register: + suspends enforcement of FCC rules requiring public and private libraries to filter Internet access; + directs the SLD to change Forms 486 and 479 to specify the types of certification that libraries will need to make under NICPA; + directs the SLD to accept Form 486 from any library that, IN YEAR 4 (or 2001), did not file the form by the deadline or that chose to file the form without certifying to CIPA; + directs the SLD to determine if there are consortia applicants that reduced their discount rates based on participants not filing Form 479 and provide them the same opportunity to request funding discounts at the original rate requested; + specifies that libraries applying only for telecommunications services and not Internet access or internal connections are exempt from NCIPA; and + specifies that the rules have not changed for schools or school libraries.
